Terms of Sale
Date of publication on the website and entry into force: 2 March 2026
1. Subject matter
1.1. These General Terms and Conditions of Sale govern the purchase of El Camös-branded products (hereinafter the “Products”) made through the e-commerce website www.elcamos.it (hereinafter the “Site”), in accordance with Legislative Decree No. 206/2005 (the “Consumer Code”), as subsequently amended and supplemented. The Site is owned by El Camös S.r.l., Via Santantonio 4/C, 25050 Passirano (BS), Italy — VAT No. / Tax Code IT04301590982, REA No. 604148, fully paid-up share capital €100,000.00, certified email (PEC) elcamos@pcert.it.
1.2. El Camös S.r.l. sells the Products through the Site in its own name and on its own behalf. The parties to any purchase of Products made through the Site shall therefore be El Camös S.r.l., as seller (hereinafter the “Seller”), and the person purchasing one or more Products for purposes outside their business, trade, craft or profession, as buyer (hereinafter the “Consumer”); the Seller and the Consumer are hereinafter referred to collectively as the “Parties”.
1.3. Any communication from the Consumer connected with or relating to the purchase of the Products — including notifications, complaints and requests concerning the purchase and/or delivery of the Products — may be sent to the Seller at commerciale@elcamos.it.
1.4. Before submitting an order, a Consumer accessing the Site to make purchases must read carefully these General Terms and Conditions of Sale (hereinafter the “General Terms”), which may be consulted at any time in the footer of the Site and which, as provided in Article 3.2 below, are made available to the Consumer for reading and express acceptance before each individual order is submitted.
1.5. Each purchase is governed by the version of these General Terms published on the Site at the time the Consumer submits the order.
1.6. The Seller reserves the right to amend these General Terms at any time, at its sole discretion and without any obligation to give prior notice to users of the Site. Any amendment shall take effect from the date of its publication on the Site and shall apply only to sales concluded from that date onwards.
1.7. The Site is dedicated to retail sales and, as such, is intended for the exclusive use of Consumers. Persons who are not Consumers are requested not to place purchase orders.
1.8. By submitting a purchase order, the Consumer agrees that the order confirmation and a summary of the order details will be sent by email to the address provided when registering on the Site or during the purchase process.
1.9. In order to make purchases through the Site, the Consumer must be of legal age (18 years) and have full legal capacity, which the Consumer hereby declares.
1.10. Any costs of connecting to the Site via the internet, including telephone charges, shall be borne solely by the Consumer, at the rates applied by the operator of the Consumer’s choosing.
1.11. The procedure for concluding the contract and these General Terms are available in the Italian language.
2. Characteristics of the Products
2.1. The characteristics of the Products are set out and described on the Site. In particular, each Product has a dedicated Product Page on the Site, describing its principal characteristics and containing the information required under applicable legislation.
2.2. The images on the Site reproduce the Products as faithfully as possible. They are, however, purely illustrative and must therefore be regarded as indicative and subject to customary tolerances. In all cases, reference should be made to the information and descriptions of the Products’ characteristics contained in the Product Page.
2.3. The Site may be accessed from anywhere in the world. For purchases of products to be delivered outside Italy, within a Member State of the European Union, please write to commerciale@elcamos.it. Such sales will be finalised by email and shall be governed by these General Terms insofar as they are compatible. Shipping costs shall be charged to the Consumer.
3. Formation of the contract
3.1. The presentation of the Products on the Site constitutes an invitation to treat, addressed to the Consumer, to submit a contractual offer to purchase; it does not constitute an offer to the public.
3.2. The purchase order is transmitted by the Consumer to the Seller by completing the checkout on www.elcamos.it. It constitutes a contractual offer and is governed by these General Terms, which form an integral part of the order and which the Consumer will be required to accept in full before transmitting the order to the Seller. In particular, before definitively submitting the order, the Consumer will be asked to read these General Terms carefully and will be given the option of printing a copy using the print command and/or of saving or reproducing a copy for their own records. The Consumer will also be asked to identify and correct any errors in the data entered before sending the order.
3.3. The Consumer’s purchase order is accepted by the Seller — and the contract is accordingly deemed concluded — when the Seller sends an order confirmation email to the address provided by the Consumer upon registering on the Site (or upon transmitting the order, where the Consumer is not registered). That email will contain a summary of the order, including a description of the characteristics of the Product ordered, the agreed price and all other information required by law. The Consumer’s order, the Seller’s order confirmation and the General Terms applicable to the relationship between the Parties will be stored electronically by the Seller in its IT systems, and the Consumer may request a copy by writing to the Seller at commerciale@elcamos.it.
3.4. The price will be charged to the Consumer upon confirmation of the order. In the event of any anomaly or irregularity in payment, the Seller reserves the right to decline the purchase offer or to terminate any contract already concluded, without the Consumer being entitled to claim compensation for any damage or to assert any other claim.
3.5. In the exceptional event that the Products ordered are unavailable, the Seller will notify the Consumer by email no later than 24 hours after the order is sent. The Consumer may then choose to: (i) receive the Product as soon as it becomes available (an indication of the timescale will be given in the Seller’s email); or (ii) ask the Seller to cancel the order and terminate the contract. In the latter case, the Seller will refund the price within 24 hours, using the same payment method used by the Consumer.
3.6. Where the exceptional unavailability affects only some of the Products included in a single order, the Seller will inform the Consumer by email within 24 hours of the order being sent, and the Consumer may choose either to cancel the entire order and terminate the contract or to proceed with the purchase of the available Products. In the latter case, the Consumer may likewise choose to receive the unavailable Products as soon as they become available (an indication of the timescale will be given in the Seller’s email). Should the Consumer decide to cancel all or part of the order, the Seller will refund the corresponding price within 24 hours, using the same payment method used by the Consumer.
4. Selection and purchase procedure; payment methods
4.1. Products presented on the Site may be purchased by selecting the Products of interest and placing them in the virtual shopping basket. Once the selection is complete, in order to purchase the Products in the basket the Consumer will be invited (i) to register on the Site by providing the requested information; or (ii) to log in, if already registered; or, should the Consumer prefer not to register, (iii) to provide their details in order to complete the individual order and allow the contract to be concluded.
4.2. The Consumer warrants that the personal information provided during the purchase and/or registration process is complete and truthful, and acknowledges and accepts that, should the information be inaccurate or not attributable to the Consumer’s identity, the Seller may be unable to complete the registration. The Consumer is responsible for the confidentiality of their username and password and undertakes to safeguard them with the utmost care. In any event, the Consumer is responsible for all activity carried out under their account.
4.3. The Consumer accordingly undertakes to indemnify and hold the Seller harmless from any damage, liability to pay compensation and/or penalty arising from, or in any way connected with, the Consumer’s breach of the above rules on registration and/or purchase on the Site and/or on the safekeeping of registration credentials.
4.4. Registration on the Site gives the Consumer access to the following features:
- creation of a personal user profile;
- saving and editing of personal data, which may be updated at any time;
- access to the archive of past orders;
- tracking of order status.
5. Delivery of goods
5.1. The Site sets out the methods and timescales for delivery of the Products, in accordance with the provisions of the Consumer Code.
5.2. Couriers are not authorised to leave the Products unattended. Accordingly, should the recipient be unavailable at the time of delivery to the address provided, the Seller — directly or through the courier it has appointed — will attempt to contact the Consumer at the telephone number and/or email address given at the time of purchase, in order to arrange delivery. Should the second delivery attempt also fail owing to the Consumer’s unavailability, the Seller will contact the Consumer using the contact details provided.
5.3. The Products ordered will be shipped by the method selected by the Consumer from among those available and indicated on the Site at the time the order is sent. The Consumer undertakes to check promptly, and as soon as possible, that the delivery comprises all and only the Products purchased, and to inform the Seller without delay of any defect in the Products received or any discrepancy with the order placed, following the procedure set out in Article 8 of these General Terms. Should the packaging or wrapping of the Products ordered arrive visibly damaged, the Consumer is invited to refuse delivery from the carrier or forwarding agent, or to accept it “subject to reservation”. The Seller’s legal guarantee of conformity under the Consumer Code, referred to in Article 8 below, applies in all cases.
6. Prices, shipping costs, duties and taxes
6.1. The price of the Products is the price shown on the Site for each Product at the time the Consumer sends the order. Prices are inclusive of all taxes but exclusive of shipping costs, which are in all cases shown as a separate item in the order summary displayed to the Consumer before the order is submitted.
7. Payments
7.1. Payment for Products purchased on the Site shall be made using the payment methods available on the Site. Under the procedure laid down by the chosen payment method, the Seller has no access to, and does not store in any way, the credit card details used for payment.
7.2. As stated in Article 3.4 above, the price will be charged to the Consumer upon confirmation of the order.
7.4. Where the Consumer terminates the purchase contract, and in every other case of reimbursement for whatever reason, the amount due to the Consumer will be refunded using the same payment method used by the Consumer.
7.5. The Seller may make further payment methods available, listing them in the payments section of the Site.
7.6. Where required by applicable law, the Seller will send a courtesy copy of the electronic invoice for the purchase to the email address provided by the Consumer.
8. Seller’s legal guarantee of conformity, notification of lack of conformity and warranty service
8.1. The sale of the Products is subject to the legal guarantee provided by the Consumer Code. The Seller is liable to the Consumer for any lack of conformity of the Products sold which exists at the time of delivery and becomes apparent within two years of that delivery. The lack of conformity must be notified by the Consumer to the Seller within two months of the date on which the Consumer discovered it. Unless proven otherwise, any lack of conformity which becomes apparent within six months of delivery of the Product is presumed to have existed at that date, unless this presumption is incompatible with the nature of the Product (for instance, because it is perishable or has a shorter expiry period) or with the nature of the lack of conformity (for instance, slight deterioration resulting from wear and tear). Damage and/or faults caused by the Consumer, and not arising from a lack of conformity, are in all cases excluded from the legal guarantee. Under the legal guarantee, the Consumer is entitled to have the conformity of the Product restored free of charge by repair or replacement, or to an appropriate reduction in price, or to termination of the contract.
8.2. The above notification of any defect or lack of conformity must be sent by the Consumer to the Seller by email to commerciali@elcamos.it, stating the defect and/or lack of conformity found and enclosing documentation evidencing the date of purchase (for instance, the order confirmation sent by the Seller and/or the receipt). Upon receipt of such notification, the Seller will provide the Consumer with all the information needed on the procedure to be followed in order to benefit from the legal guarantee.
8.3. Where the Seller is required to refund the price paid to the Consumer, the refund will be made, wherever possible, using the same payment method used by the Consumer at the time of purchase. In such case, the Consumer must send the Seller their bank details by email to commerciale@elcamos.it, so that the Seller may make the transfer in the Consumer’s favour and return the sum due.
9. Liability for defective products
9.1. With regard to any damage caused by defects in the Products, the relevant provisions of Italian Legislative Decree No. 206/2005 (the Consumer Code) shall apply.
10. Right of withdrawal and exclusions
10.1. Without prejudice to the exclusions provided for in Article 10.7 below, the Consumer has the right to withdraw from the purchase contract within 14 (fourteen) days of receipt of the Products, without giving any reason and without incurring any costs other than those of returning the Products to the Seller, as provided in Article 10.3 below, in accordance with Article 57(1) of the Consumer Code. Information on the right of withdrawal will be available on the Site at all times. Where several Products ordered by the Consumer in a single order are delivered separately, the 14 (fourteen) day withdrawal period runs from the day on which the last Product is delivered.
10.2. Within the aforementioned 14-day period, the Consumer must inform the Seller of their decision to withdraw from the contract by sending the Seller, by email to commerciale@elcamos.it, any other unequivocal statement setting out their intention to withdraw from the contract.
The Seller will confirm to the Consumer without delay — by email to the address provided at registration or at the time of purchase — receipt of the notice of withdrawal, giving instructions for the return of the Product(s).
10.3. The direct costs of returning the Products to the Seller shall be borne by the Consumer. The Consumer shall return the Products within 14 (fourteen) days of the date on which they informed the Seller of their decision to withdraw from the contract. The Products must be returned to the following address: El Camös S.r.l., Via Santantonio 4/C, 25050 Passirano (BS), Italy — VAT No. / Tax Code IT04301590982, REA No. 604148, fully paid-up share capital €100,000.00, certified email (PEC) elcamos@pcert.it.
10.4. The Consumer is liable only for any diminished value of the goods resulting from handling of the Products other than what is necessary to establish their nature, characteristics and functioning. The Products must in any event be kept, handled and inspected with ordinary care and returned intact (free of any sign of wear, abrasion, chipping, scratching, deformation, etc.), complete in all their parts, together with all accessories and instruction leaflets, with labels and tags still attached, and fit for their intended use.
The right of withdrawal, moreover, applies to the Product in its entirety. It may not, therefore, be exercised in respect of individual parts and/or accessories of the Product.
10.5. Where the right of withdrawal has been validly exercised by the Consumer within the prescribed period, the Seller will refund to the Consumer the full amount paid for the purchase of the Products, including the shipping costs originally incurred at the time of purchase, within 14 (fourteen) days of the date on which the Seller was informed of the Consumer’s decision to withdraw. The Seller nevertheless reserves the right to withhold the refund until it has received the Products back, or until the Consumer has supplied evidence of having sent them back, whichever is the earlier.
10.6. The refund will be made using the same payment method used by the Consumer for the original purchase, unless the Consumer has expressly requested a different method by email to commerciale@elcamos.it. Where payment was made by credit card, the refund will be made within the stated period by crediting the sum due directly to the credit card used by the Consumer for payment.
11. Intellectual property rights
11.1. The Consumer acknowledges that all trade marks, names and any other distinctive signs and designations used on the Site are and shall remain the exclusive property of El Camös S.r.l., the owner of the trade mark, and that no right in them may accrue to the Consumer by virtue of accessing the Site and/or purchasing the Products.
11.2. The reproduction, in whole or in part, of the contents of the Site is prohibited, as is their transfer by electronic or conventional means, their modification or their use for any purpose whatsoever.
12. Consumer data and privacy
12.1. In order to register, submit an order and thereby conclude this contract, certain personal data of the Consumer are requested through the Site. To that end, the Consumer must read the privacy notice made available by the Seller as data controller.
12.2. The Consumer represents and warrants that the data provided to the Seller during the registration and purchase process are accurate and truthful.
12.3. The Consumer may at any time update and/or amend the personal data provided to the Seller through the “My Account” section of the Site, accessible upon login.
12.4. For any further information on how the Consumer’s personal data are processed, please consult the Privacy Policy section.
13. Governing law, competent court and European platform for out-of-court dispute resolution
13.1. Every contract of sale concluded between the Seller and Consumers under these General Terms shall be governed by and construed in accordance with Italian law. In any event, any rights conferred on Consumers by mandatory provisions of law in force in their country of residence shall remain unaffected.
13.2. Any dispute shall fall within the exclusive jurisdiction of the court of the place where the Consumer resides or has elected domicile.
13.3. Pursuant to Article 14 of Regulation (EU) No. 524/2013, the Consumer is further informed that, in the event of a dispute, a complaint may be lodged through the European online dispute resolution (ODR) platform made available to consumers by the European Commission. The platform may be accessed at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=IT and serves as a point of access for consumers wishing to settle out of court disputes arising from contracts for the online sale of goods or services.
